What Is the Time Deadline (Statute of Limitations) For Filing an Uninsured Motorist Claim In California

Like other personal  injury and accident claims, there is a two year "Statute of Limitation" for filing an uninsured motorist claim in California.  This means that, if you are injured by a driver who has no insurance (uninsured motorist) or less insurance coverage than your own policy (underinsured motorist), you have two years to do one of two things as follows:

  1. File a lawsuit for bodily injury against the uninsured or under insured driver in court and provide your insurance company notice of the claim; or
  2. Formally demand arbitration with your own insurance carrier of the claim.
